The policeman, Justice Dladla, it is alleged, shot the victim, Pardington Gonye, who had killed his colleague, Ajith Krishanlal, during a robbery at the KFC in New Germany in October last year.
Now the State is preparing what it believes to be a strong case of murder and defeating or obstructing the course of justice against Dladla, to be heard in the Durban High Court in the coming months.
And, suspected killer and thief Mduduzi Dlamini, who did not pull the trigger that killed Gonye but was part of the gang that robbed the takeaway, is also being charged with causing the untimely death of his accomplice and the policeman who died.
It is believed that Dladla, a Pinetown policeman, saw Krishanlal go down and apprehended Gonye, the man who it is thought pulled the trigger.
But the Independent Police Investigative Directorate alleges that he then did the unspeakable. Once he had the shooter controlled and wounded - sprawled in front of him - he killed him. He then tried to cover up his crime by placing the gun in a way that looked as if Gonye was the aggressor. What Dladla allegedly did was captured on CCTV.
The directorate arrested Dladla in March and he has since made several brief appearances in the Pinetown Magistrate’s Court.
He is out on a warning and is to appear in the high court in September when a trial date is expected to be set.
Dlamini will stand trial in September for his role in the robbery and, among the charges he is facing, is also one for Gonye’s murder.
Because of his role in the robbery Dlamini is also charged with Krishanlal’s murder, the attempted murder of Krishanlal’s partner, Jerome Mngoma, who was shot in the leg during the shootout but survived, and robbery with aggravating circumstances.
